Do I need to pay a fee to re-submit a planning application?
The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits)(England)(Amendment) Regulations 2023 has removed the right to a free go where a previous application has been approved, refused or withdrawn.
A transition period is available for applications that were withdrawn, approved or refused in the preceding 12 months. To be eligible for a free go within this period, which expires on 5 December 2024, no fee is payable for a single revised application as long as:
- It is of the same character and on the same site as the earlier application, and submitted by the same applicant
- It is submitted within 12 months of the earlier approval/refusal or the application received date in the case of a withdrawn application
- In the case of an application which is not made in outline, that the previous application was also not made in outline.
This transition period expires on 5 December 2024 and from 6 December 2024 onwards, there will be no free go applications.
