Section 106 Affordable Housing Contributions

Responded Mon 09 January 2023Please provide the following information concerning Section 106 affordable housing agreements over the last 10 years.
For each S106 affordable housing agreement entered into, please provide:
1. The date of the agreement
2. The reference of the agreement
3. Names of the contracted party or parties
4. The number of affordable housing units or
5. The financial equivalent paid
6. The date the obligation was expected to be fulfilled (either units built or financial equivalent paid)
7. The date the obligation was fulfilled (either units built or financial equivalent paid)
Response
Please see attached report which covers the records we hold of Planning Obligations established through Section 106 (s106) or Unilateral Undertakings (UU) signed over the last 10 years held on our Development Management system.
Where an obligation is recorded as not finished, the application is likely to have been superseded by a later application at the same address.
Where the obligation is recorded as part paid/project part completed it confirms some element of completion of works but not total completion.
Where the proposed amount and number of dwellings is zero this confirms a change to the planning permission decision resulting in no affordable housing.
The Infrastructure Funding Statements (IFS) which can be found on our website Annual Infrastructure Funding Statement (hastings.gov.uk) confirms the amount remaining, outstanding and allocated expenditure for s106 payments. Appendix B of the latest IFS has been introduced to confirm affordable housing obligation payment status.
Search for a planning application (hastings.gov.uk) will give you the background information you need about searching for planning applications.
You can then choose the option to 'view planning applications' which you will find at the top of the right hand side of this page under the magnifying glass symbol. Once you are on the search page just enter each application number exactly as they are written in the attachment into the keyword box on the search screen.
All planning applications relating to that reference number should appear, ignore those that relate to any conditions which have been discharged and choose the main application by clicking on the description of development. From there you need to click on the 'documents' tab.
This will take you to the documents held on the case where you will be able to find the S106/Legal Agreement relating to the planning permission.
You can sort the date order so the most recent appears first and you should find the Legal Agreements at or near the top of the documents shown.
To open the document click on the document symbol to the right hand side in the 'View' column.
This will confirm the signatories, dates and full details of all the Legal Agreements referred to on the attached list.
