Following our update on 39–41 George Street at the end of last year, when the council contacted the site owner at an informal stage, we recognise the continued concern regarding the condition of the site and understand residents’ frustration that there has been no visible improvement since previous assurances were given.
The council wrote to the owner in December to provide an opportunity for the necessary works to be carried out voluntarily. As those improvements have not been delivered, the council has now begun the formal planning enforcement process. A Section 215 notice has been issued to the owner requiring the condition of the site to be addressed.
The owner has ten working days to respond to the council’s correspondence.
If no satisfactory response is received, or appropriate action is not taken, the council will consider the use of its powers under the Town and Country Planning Act 1990 to take further enforcement action.
We appreciate that the lack of visible change is disappointing for residents. However, the council must follow the correct legal processes to ensure that, if further escalation becomes necessary, any action taken is robust and legally sound.
