Section 106 - Housing

Responded Wed 24 December 2025I would like to request the following information under the Freedom of Information Act 2000, looking at the use of Section 106 of the Town and Country Planning Act 1990 and its use in the provision of affordable housing.
Please may you provide me with data per annum on the following questions:
- What is the unit count of affordable housing that has been developed, or is currently being developed by the council in the last 5 years.
- How many social homes/ developments in the last 5 years were agreed with and under Section 106, in order to mitigate the impact of the developments upon surrounding communities?
- How many of these social homes delivered under Section 106 are currently unoccupied with no buyer or social landlord?
- Are there any Section 106 building sites currently delayed due to uncontracted units, and if so, how many?
I would like this information to be provided in this format:

1. Hastings Borough Council (HBC) carried out a large scale voluntary transfer of its housing stock in 1996 and subsequently only has a relatively small portfolio which is used for temporary accommodation, including longer term move-on. Through the council's housing acquisition programme, we have delivered new affordable housing through the purchasing and refurbishment of homes. Through this model the council has delivered 45 social/affordable rent homes between 2020/2021 and 2024/25. During the same period, the council delivered 17 additional homes with rents capped at Local Housing Allowance rates.

2. Data available on the website in monitoring years in the Infrastructure Funding Statements (IFS) for 2019/20, 2020/21, 2021/22, 2022/23 and 2023/24. Refer to IFS table I which confirms non monetary contributions secured in the related monitoring year. 3. The wording in 2. is unclear however, HBC can confirm that we are not aware of any S106 homes delivered that are unoccupied due to there being no buyer or social landlord.
4. HBC are not aware of any S106 sites that are delayed due to uncontracted units.
