      Bird feeding FPNs

      I am writing to you under the Freedom of Information Act 2000 to request the following:

      - From March 2019 to March 2023, how many fixed penalty notices (FPNs) were issued to people for feeding ducks in public places by enforcement officers working for/acting on behalf of the council?
      - Please provide a breakdown of each FPN, including the location, date of issue, FPN amount, the official reason for the FPN, powers under which it was issued, whether the FPN was paid, and whether it was appealed, rescinded before payment, or later refunded.
      - How many of these people were prosecuted for non-payment of their FPNs and what was the outcome of these proceedings?
      - If there are any further details recorded which provide context regarding the nature and circumstances of the individual fines please also provide this if possible within cost/time limits.

      - Please repeat the search for 'pigeons', 'seagulls', and 'birds', within the same date range, providing answers to the same questions as written above for each.

      From March 2019 to March 2023, how many fixed penalty notices (FPNs) were issued to people for feeding ducks in public places by enforcement officers working for/acting on behalf of the council?

      Answer: Nil - there is no provision for us to issue an FPN for this as an offence. There is a also no offence under the byelaws around this either. The only way an FPN could be issued for this is if a PSPO was created specifically banning this activity or if a Community Protection Notice was issued to an individual but the activity would have to be deemed to be having a detrimental effect on the quality of life of those in the locality, and is unreasonable, and the behaviour is of a persistent or continuing nature. A sanction of a CPN is to issue an FPN

      Please provide a breakdown of each FPN, including the location, date of issue, FPN amount, the official reason for the FPN, powers under which it was issued, whether the FPN was paid, and whether it was appealed, rescinded before payment, or later refunded.
