Use of CCTV technologies

Responded Fri 04 December 2020Under the Freedom of Information Act can you, please provide me with the following information:
1. Can you confirm if you operate CCTV at recycling centres under your control?
2. Can you confirm all the alternative methods you have used to discourage fly-tipping at the recycling centres under your control? If you have used alternative methods (signage, website notices, posts to social media, campaigns), please detail and provide copies of communications and signage used.
3. Can you confirm if your Council uses CCTV technologies for the prevention, investigation or detection of litter or waste management related offences? If you do use CCTV technologies (for above) can you confirm under what parts of the Waste regulations or Environment Protection act that regulate the processing of images of members of the public using CCTV footage did you use to establish your lawful basis? Please reference the specific parts of the legislation that regulate this type of data processing (CCTV recording) when outlining your legal basis for the use of CCTV technologies for the prevention, investigation or detection of litter or waste management related offences.

Q2. There is signage at each site, we do not have photos.
Q3. The council only operates a public place CCTV system in partnership with Sussex Police for the prevention and detection of crime and to reduce the fear of crime. The lawful basis for implementing CCTV is the Data Protection but also takes account of Protection of Freedoms Act (POFA), RIPA and HRA 1998.
