Responded Thu 07 February 2019I would like to make a request under the Freedom of Information Act regarding housing evictions.Section 160 of the Localism Act 2011 ended the right of secure tenancies for the children of the secure tenant upon their death. The Act states that only the spouse or civil partner can succeed secure tenancies.This was extended by the Housing and Planning Act 2016, by applying the rule retrospectively to pre-2012 tenancy agreements.Therefore:Please could you tell me how many evictions the council made in 2018 which related to Section 160 of the Localism Act 2011?In other words, how many evictions were made following the death of a secure tenant because there was no right for the other occupant(s) to succeed the tenancy?

Hastings Borough Council have not made any evictions in 2018 which related to Section 160 of the Localism Act 2011.
