Council tax summonses and liability orders

      Requested Wed 25 April 2018
      Responded Tue 01 May 2018

I would like to make a request under the Freedom of Information Act.

      1. How many court summonses did you issue or were issued on your authority's behalf for late or non-payment of Council Tax in:

      a) 2016/17

      b 2017/18

Please break this data down by the wards of the addresses to which the summonses were sent.

      2. How many council tax liability orders were issued in your authority as a result of the summonses issued in Q1 during:

      a) 2016/17

      b) 2017/18

Please break this data down by the wards of the addresses to which the liability orders were applied.

Please specify for Q2 precisely which powers the courts gave to you (e.g. salary deductions, benefits deductions etc.) if possible. Such a table might look like this:

Power / times granted in 2016/17 / times granted in 2017/18

      benefits deductions / 5,000 / 7,000

      bankruptcy applications / 20 / 30

I would prefer this data to be supplied in soft copy spreadsheet (.xls) format. If you require any clarification of any part of this request, please do not hesitate to contact me.

      Response

      1a - 1416

      1b - 1457

      2a - 1632

      2b - 1249

We do not hold ward data on our Council Tax database. The powers granted for Liability Orders by the magistrates Court gives the Council the powers to use one of the following methods of recovery and it is up to the Council to decide which is appropriate or to move onto the next method is not successful.

During 2016/17 for all years outstanding we took the following action - In the first instance offered all an arrangement then if not kept to: Benefit deductions - 629, Earnings deductions - 678, Charges on property - 17, Bailiff action - 971.

During 2017/18 - for all years outstanding - Arrangements offered to all and then: Benefit deductions - 331, Earnings deductions - 361, Charge on property - 7, Bailiff action - 348.
