Verification of Section 106 Financial Records

Responded Tue 12 May 2026I am writing to request information regarding Section 106 (S106) contributions secured under the following planning agreement(s):
Specifically, I would like to understand:
· The total amount of S106 funding secured under these agreements
- The amount that has been spent, and on which projects
- Any remaining unspent balance
- The relevant clawback/expiry dates
- What has happened to any unspent funds where the clawback period has expired
If any funds have not been returned or reallocated, I would be grateful for clarification on the legal basis for their retention.

Hastings Borough Council does not hold a list of agreements you are referring to?
However, please refer to the Infrastructure Funding Statement for details of contribution balances and spend via https://www.hastings.gov.uk/planning/AnnualInfrastructureFundingStatement/
You can read the detail of the S106 agreements which will include clawback clause if relevant via the public access planning application search facility available from this page on the website https://www.hastings.gov.uk/planning/searching/
Insert the application number and look for the legal agreement (S106 or DoV) in the documents associated with whatever application you are interested in.
Hastings Borough Council always have spent the money within the timeline and we never had to return any money related to S106 back.
