HS/CD/22/00389 Discharge of Conditions - Site of Mount Pleasant Hospital

      Requested Wed 01 March 2023
      Responded Wed 08 March 2023

I am requesting that you send me a document from your planning archive that did not appear on your planning website:

HS/CD/22/00389& Discharge of Conditions 3 parts (i) and (ii) only (foul and surface water), 5 (Vehicular Access), 6 (Visibility Splay), 7 (Site Detail Drawings), 9 (Cycle Storage), 10 (Construction Management Plan), 11 (Site Remediation), 14 (Acoustic specifications), 16 (Archaeological), 18 (Air Quality Mitigation Assessment and Cycleway Specification), 19 (Water Supply Main), 21 (Soft Landscaping), 24 (Bin Storage), 25 (Construction Environment Management Plan), 26 (Method Statement (for works close to the badger sett)), 27. (Biodiversity Monitoring Strategy), 30 (Materials), 31 (Climate Change Mitigation) of Planning Permission HS/FA/19/00536: Redevelopment of part of the former hospital site to provide 7 units comprising 3 (3-bed) townhouses and 4 (2-bed) apartments, with associated works including adjustments to the existing access, provision of car parking spaces, and landscaping. Site of Mount Pleasant Hospital, 7 Frederick Road, Hastings, TN35 5AA

Quite clearly, I asked you to provide me with a document titled 'Site Remediation Notice' for this site under this planning reference HS/CD/22/00389 which you have discharged, or inform me that remediation can occur on a site without notice? Section IIA of the Environmental Protection Act of 1990 (EPA 1990) appears to have been violated. No remediation notice has been provided to date. Are these remediation notices not transferable to another party? Is your contempt for this matter clear evidence that your planning department is acting illegally and should be shut down and instead run by East Sussex County Council? You are aware this matter: 11 (Site Remediation) has been discharged.

      Response

There is no Site Remediation Notice submitted with application HS/CD/22/00389 and there is no requirement to do so for planning purposes.

All the requirements in respect of condition 11 have been addressed through the submitted information, which is available to view on our website at:
