Request 1 - Land at Frederick Road (road to nowhere) Millennium ground request Former Mount Pleasant Site, for CEMP Section 41 information

Responded Thu 19 January 2023I ask you to recall. I wrote under Information Request in respect to the lawful use of CEMP, CESMP and Section 41 in your planning authority's matters (1st February 2022) which I expected you to deal with under EIR. I informed you that I could not find any documents regarding proper handling of these legal matters, and that it was not clear that you had any. I asked you for a Decision Notice or in the application for mitigation, CEMP for Section 106 Voluntary Agreements or Section 41 list of Protected Habitats. CEMP entries are included as part of this lengthy outstanding request. In regard to Section 41 properties, which I asked you to verify that you had all stages of CEMP which is not currently evident, you could provide no documentary evidence to satisfy this requirement.
On the 23rd November 2021 I asked your Planning Authority, 'Can you please inform me what date the developer/contractor submitted CESMP Plan which is a working document that defines how a site will mitigate its potential impacts through construction on the environment and local community or a comprehensive part therein, an EMP an environmental management plan which describe how an action might impact on the natural environment in which it occurs and set out clear commitments from the person taking the action on how those impacts will be avoided, minimised and managed so that they are environmentally acceptable.' You provided no evidence of working document to me!
I therefore ask you, in respect to the contractor working in the area at the top of Frederick Road, on his own driving a digger, how under previous planning your authority cleared an area of land fenced with low fence to protect protected species on the site that it appears without CEMP agreement with the contractor it has been cleared by the 29th December 2022.
1. Can you therefore provide documents in regard to the handling of this matter under information request?
2. Can you provide me the details of the whereabouts now of these protected species?
