The following has been agreed as the split of enforcement responsibility in Hastings between Environmental Health and Trading Standards.
Food & Drink - Environmental Health
Restaurants and public houses, wine bars or other food and drink establishments including within hotels and members' clubs . Cafes and canteens.
Retail - Trading Standards
All retail. Hairdressers, barbers, beauty and nail salons, including piercing and tattoo parlours. Indoor and outdoor markets. Auction houses.
Accommodation - Environmental Health
Hotels, hostels, B&Bs, holiday rentals, campsites and boarding houses for commercial use. Caravan parks/sites for commercial uses
Non-Residential Institutions - Environmental Health
Libraries, community centres, youth centres and similar. Places of worship.
Assembly and Leisure - Environmental Health
Museums and galleries, nightclubs, cinemas, theatres and concert halls. Bingo halls, casinos, and betting shops. Spas and massage parlours. Skating rinks. Fitness studios, gyms, swimming pools or other indoor leisure centres. Arcades, bowling alleys, soft play centres and similar. Funfairs.
Outdoor Recreation - Trading Standards
Playgrounds, sports courts and pitches, and outdoor gyms or similar.
To assist with clarity, an "outdoor gym" can best be described as a permanent gym built outside in a public space, accessible to all, with all-weather construction of the exercise equipment somewhat modelled on playground equipment. Enforcement sits neatly with Trading Standards, alongside playgrounds etc.
Alternatively, any other form of "gym" (whether situated inside or perhaps the situation whereby an inside gym has moved their equipment outside) would be covered by Environmental Health.
A physical trainer operating a boot camp type of activity in a public park is not being considered a gym as such, but would be a 'gathering issue' for the police.
On a linked note, an organised football team training session in a public park would be a police matter. However as long as the event was not affecting the public safety due to its scale and manner in which it was being run then no enforcement would likely result.
