Hastings Local Plan 2004

The new Hastings Local Plan was formally adopted by the Borough Council on 14 April 2004.  The 2004 Local Plan is the statutory local plan for Hastings Borough, replacing the 1993 Hastings Borough Plan and the Combe Haven Valley District Plan (adopted 1983).  The Local Plan 2004 sets out a framework of policies to guide and encourage development in Hastings Borough, whilst safeguarding and enhancing the environment.

The 2004 Local Plan has two main functions:

  1. to set out the Council's policies for the control of development in the Borough;
  2. to make proposals for the development and use of land, and to allocate land for specific purposes.

Hastings Local Plan 2004 - Expired Policies

As from September 27, 2007, a number of policies in the Adopted Hastings Local Plan 2004 expired and are therefore not to be used in consideration of planning applications.  This was approved by the Secretary of State under paragraph 1(3) of Schedule 8 of the Planning and Compulsory Purchase Act 2004 and is part of the Government's drive to streamline the planning system.

These policies were not longer required as in some cases they duplicated other Local Plan policies or National Planning Policy and in other cases the development they referred to has been completed.

The following Hastings Local Plan policies have been expired:

  • B2 - Broomgrove Housing Sites
  • CN2 - Parking for People With Disabilities
  • CN4 - Hastings College
  • CN5 - Hastings College - Relocation
  • CN8 - Community Facilities
  • CN10 - Library Facilities
  • CN11 - Hastings Museum and Art Gallery
  • DG10 - Retention of Car Parking
  • DG32 - Development Adjoining Railways
  • H3 - Lower Density Areas
  • H5 - Change of Use
  • L5 - Farm Diversification
  • OT1 - Old Town Protection Area
  • S6 - Land Allocated for Non-Retail Uses
  • SP5 - Football - Pilot Field
  • T10 - Conference Facilities
  • T11 - Water Based Recreation
  • T5 - Self-Catering Accommodation
  • TC2 - The Queens Hotel
  • TC6 - The BT Building, Havelock Road

Following September 27, 2007, the remaining policies in the Local Plan should be read in context.  Where policies were adopted some time ago, it is likely that material considerations, in particular the emergence of new national policy in the National Planning Policy Framework and also new evidence, will be afforded considerable weight in decisions.

Supplementary Planning Guidance

Supplementary Planning Guidance Notes (SPGs) provide detailed guidance for both residents and developers on the way in which the Council implements Local Plan policies.  They do not have the same status as Local Plan policies, but are taken into account as a material consideration when planning applications and appeals are determined.  The following SPGs were adopted as interim guidance by Council on 28th July 2004, and give guidance on the following:

As part of the emerging Local Plan these SPGs will be subject to formal consultation and be taken forward as Supplementary Planning Documents (SPD).  No timescale for this has yet been identified. 

SPG 1 - Roof Materials for Listed Buildings and Conservation Areas, SPG 2 - Replacement Doors and Windows for Listed Buildings and Conservation Areas, SPG 3 - Shopfront Design, and SPG 4 - Outdoor Advertisements and Signs, have already been taken through this process and are available for download from our documents page.

Hastings Borough Council has also adopted East Sussex County Council's "Parking Standards at Development" as Supplementary Planning Guidance.

Monitoring the Local Plan

Regular monitoring of the Local Plan and its policies takes place to advise the Council on how the Plan policies are working in practice, and will also provide a useful input into the new Local Development Framework.

Provides a general introduction to the Council monitoring of the Local Plan, together with a short commentary on the monitoring results for each of the main topic chapters in the Local Plan.
